Terms of Service
Important Safety Warning: Hiking, peak-bagging, and backcountry travel involve serious risks including injury and death. List Hiker provides informational content and recreational tracking only - it is not a substitute for proper preparation, experience, equipment, and judgment. Always verify conditions with official sources before hiking. In an emergency, call 911 (or your local emergency number), not List Hiker.
1. Acceptance of Terms
By accessing or using List Hiker (“the Service”), operated by List Hiker LLC, a New Hampshire Limited Liability Corporation (“we,” “us,” or “our”), at listhiker.com or in the List Hiker App, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
These Terms should be read alongside our Privacy Policy, which explains how we handle your personal data.
2. Description of Service
List Hiker helps hikers and outdoor enthusiasts track their progress on peak-bagging and trail lists. The Service:
- Matches your GPS tracks against peak coordinates and trail segments to determine which list items you have completed
- Tracks your progress across hiking lists, applying each list's specific completion rules such as seasonal boundaries, counting rules, etc.
- Through the List Hiker mobile app, records your GPS activities directly and provides on-device features such as proximity awareness of nearby peaks
- Integrates with and imports data from third-party activity tracking services including Strava, Garmin, AllTrails, Apple HealthKit, and others
- Allows you to share your progress, document completion of requirements for certification and badges, and connect with the hiking community
3. Account Registration and Security
- You must provide a valid email address and create a password to register. You agree to provide accurate and complete information.
- You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at listhiker.com/contact if you suspect unauthorized access.
- You must be at least 16 years old to create an account.
- At our sole discretion we may lock access to your account or take other appropriate actions if we detect fraudulent or malicious access.
4. User Content and Data
You retain ownership of all data you provide to List Hiker, including any uploaded files, profile information, and activity data. Data acquired through third-party APIs such as Strava is subject to the terms of those services. See our Privacy Policy for details on how third-party data is handled.
By using the Service, you grant List Hiker a non-exclusive, royalty-free, worldwide license to process, store, display, analyze, and create derivative data (such as peak match results and completion statistics) from your content, solely for the purpose of providing and improving the Service. This license terminates when you delete your content or your account, provided that anonymized, aggregated derivative data (such as peak popularity statistics and matching accuracy metrics) created prior to deletion may be retained by List Hiker.
You are responsible for ensuring that any content you upload does not violate the rights of others or applicable law.
We reserve the right to remove content, suspend access, or terminate accounts if we reasonably believe there has been a violation of these Terms, applicable law, or the rights of any third party. We may also disclose your data or take action on your account when required by valid legal process such as a court order, subpoena, or government request, or when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of List Hiker, our users, or others.
5. Third-Party Integrations
5.1 Strava
If you connect your Strava account, your use of Strava data through List Hiker is also governed by Strava's Terms of Service and the Strava API Agreement (each as updated June 1, 2026). You can disconnect your Strava account at any time from your My Data page or directly through Strava's app settings.
Strava data disclaimer: Data received from the Strava API is provided “AS IS” without warranty of any kind. List Hiker makes no representations or warranties regarding the accuracy, completeness, or reliability of data provided by Strava. Strava, Inc. is not responsible for any errors, omissions, or inaccuracies in the data delivered through their API, and List Hiker disclaims all warranties, express or implied, with respect to such data.
5.2 Importing Data
We support additional data sources including Garmin Connect, AllTrails, and Apple HealthKit as well as data you create yourself. When you provide any data to us, you are representing that you own the data and are fully authorized to share it with List Hiker.
5.3 Third-Party Liability Exclusion
Third-party service providers, including but not limited to Strava, Inc., are not parties to these Terms and bear no responsibility for the Service. To the maximum extent permitted by applicable law:
- Third-party service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any data received through their platforms.
- List Hiker's integration with third-party services does not imply endorsement, partnership, or affiliation with those services.
6. Acceptable Use
You agree not to:
- Use automated means (bots, scrapers, crawlers) to access the Service or extract data, or conduct any text or data mining, web scraping, or automated analytical technique aimed at extracting patterns or data from the Service. You agree to comply with all technical access restrictions including robots.txt and site map directives.
- Download, copy, scrape, redistribute, or otherwise use photographs or other images from the Service except as permitted by Section 7.1 or by a visible open-license attribution on the specific image.
- Reverse engineer, decompile, or disassemble any part of the Service
- Attempt to circumvent security measures, authentication, or access controls
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Access or attempt to access another user's account or data
- Submit false or misleading activity data, completion claims, or peak ascent records
- Use the Service for any illegal purpose or in violation of applicable law
- Upload content that infringes intellectual property rights, contains malware, or is otherwise harmful
7. Intellectual Property
The List Hiker service, including its software, design, branding, written content, and curated media (including photographs, illustrations, and graphics displayed on the Service), is owned by List Hiker or licensed to List Hiker by third parties, and is protected by United States and international copyright, trademark, and other intellectual property laws.
7.1 Photographs and Curated Media
Photographs and other images displayed on List Hiker — including but not limited to peak photographs, trail segment imagery, list cover images, and editorial photography — are either the property of List Hiker or used under license or permission granted to List Hiker by the copyright holder. Except as expressly permitted by these Terms or by a visible attribution notice identifying an open license (such as Creative Commons or a public-domain dedication) and the terms of that license:
- You may view photographs and other images within the Service as part of your ordinary use of the Service.
- You may not download, copy, reproduce, republish, redistribute, scrape, mirror, cache beyond your browser's ordinary operation, sell, license, incorporate into another work or dataset, or otherwise use any photograph or image from the Service for any purpose outside of your ordinary personal use of the Service itself.
- Rights-management metadata, watermarks, credits, and attribution notices may not be removed, altered, or obscured.
This Section 7.1 does not restrict your rights to photographs or other content you yourself upload to the Service; those remain subject to Section 4 (User Content and Data).
7.2 Reference Data
List Hiker's reference data — including peak locations, elevations, trail segment geometries, list definitions, completion rules, and related metadata — is a combination of data derived from public sources such as OpenStreetMap, data licensed to List Hiker by third parties, and data independently researched, corrected, curated, and generated by List Hiker. Portions of the data originally derived from OpenStreetMap remain available under the Open Database License (ODbL); List Hiker's independent corrections, curation, additions, and contributions are the property of List Hiker. List completion rules and criteria are derived from the published guidelines of the sponsoring organizations for each list.
7.3 Third-Party Trademarks
Strava and the Strava logo are trademarks of Strava, Inc. Their use on List Hiker is in accordance with Strava's Brand Guidelines.
8. Hiking Safety and Assumption of Risk
List Hiker is not a navigation tool, safety device, or substitute for proper trail planning and judgment.
Hiking, peak-bagging, and backcountry travel involve inherent and significant risks including but not limited to severe weather, hypothermia, falls, wildlife encounters, getting lost, serious injury, and death. You assume all risks associated with your outdoor activities.
The GPS matching, peak identification, and completion tracking features of List Hiker are provided for informational and recreational tracking purposes only. They may contain errors or inaccuracies. Do not rely on List Hiker for navigation, route planning, or safety decisions. Always carry appropriate maps, navigation equipment, and safety gear, and exercise your own good judgment in the field.
The List Hiker mobile app includes features that show your proximity, heading, and distance to nearby peaks, and it may display maps that continue to function without a network connection. These features are provided as a convenience for recreational tracking only. Their presence does not make them suitable or intended for navigation, and you must not rely on them — or on any part of List Hiker — as a navigation tool or safety device. Map data and proximity information may be incomplete, out of date, or inaccurate, and may be unavailable when you need it most.
BY USING LIST HIKER, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH HIKING AND OUTDOOR ACTIVITIES. YOU AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN SAFETY AND WELL-BEING, AND THAT YOU WILL MAKE YOUR OWN INDEPENDENT DECISIONS ABOUT WHEN AND HOW TO HIKE. IN AN EMERGENCY, CALL 911 (OR YOUR LOCAL EMERGENCY NUMBER), NOT LIST HIKER.
The inclusion of a peak or trail segment in List Hiker's database does not indicate that it is legal, safe, or recommended to access. Some peaks may be on private land, require technical climbing skills, or be seasonally inaccessible. Always research access requirements and conditions before attempting any peak or trail.
List Hiker is not responsible for any injury, loss, or damage arising from your outdoor activities, regardless of whether those activities were tracked or motivated by the Service.
9. Beta Features
We may offer beta or experimental features from time to time. When we do so we will identify these features as such. These features:
- May be changed, degraded, or removed without advance notice
- Are provided “as is” without additional warranties beyond those in Section 10
- May have different usage limits or terms communicated at the time of access
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing, List Hiker does not warrant that:
- GPS matching will accurately identify all peaks or trail segments you have visited
- Completion tracking will be error-free or reflect the official records of any sponsoring organization
- Data received from or exported by third-party services (including Strava) will be accurate, complete, or timely
- The Service will be uninterrupted, secure, or free of errors
11. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by applicable law.
SUBJECT TO THE ABOVE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIST HIKER LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
LIST HIKER LLC'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LIST HIKER LLC FOR ANY SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Third-party service providers, including Strava, Inc., are expressly excluded from any liability for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any data delivered through their platforms.
For users in the United Kingdom: If defective digital content that we have supplied damages a device or digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless List Hiker LLC and its officers, directors, employees, members, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any rights of another party.
13. Account Termination
By You
You may delete your account at any time from your My Data page. Upon deletion, your data is immediately and permanently deleted, and connected third-party accounts (e.g. Strava) are deauthorized and associated data is removed.
By Us
We may suspend or terminate your account if you violate these Terms, including the Acceptable Use provisions. Where possible, we will provide notice and an opportunity to remedy the violation before termination.
14. Assignment and Business Transfers
We may transfer our rights and obligations under these Terms to another organization in connection with a merger, acquisition, or sale of assets. We will notify you in writing if this happens and ensure the transfer does not affect your rights under these Terms.
You may not assign or transfer your rights under these Terms without our prior written consent.
15. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of New Hampshire, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If negotiation is unsuccessful, disputes shall be resolved in the state or federal courts located in New Hampshire.
If you are a consumer in the European Union, United Kingdom, or Canada, nothing in this section limits your rights under mandatory consumer protection laws of your jurisdiction, including your right to bring claims in your local courts.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email (if you have an account) and/or by posting a notice on our website at least 30 days before the changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
